What you get, what we ask of you, and what has not been decided yet.

This is a draft, written by us and not by a lawyer. It describes what the system actually does, field by field, so that a lawyer can read it and correct it. It is not legal advice, and nobody with legal training has reviewed it.

Who the agreement is with

The service is provided by registered company name, organisation number org.nr, postal address. Creating an account forms an agreement with us on the terms set out here.

What the service does

Empalyze reads the content on your website and shows the journey a buyer walks through it — where it holds, and where it breaks. What we show is built from the site’s own sentences, and we quote them as they stood.

We do not measure visitors on your website, and we count nothing we have not read. An observation you get from us can be traced back to the page it came from.

The account and the first read

The button on the front page creates your account and starts the read in one movement. The first read is free, and it takes no card.

You are responsible for what happens on your account, and for keeping your password to yourself. If you find someone else in it, tell us.

The website you ask us to read

You may ask us to read a website you run yourself, or one you have the right to let us read. We fetch only pages that are already published publicly, we sign in nowhere, and we obey robots.txt.

This clause must be finished by a lawyer. The system does not today check that whoever submits an address owns the website at it, and a read stores that website’s content — including any personal data on it. How this should be handled is a decision for the owner.

Payment

If you become a paying customer, payment goes through Stripe. Your card details go to Stripe and not to us.

Price, billing interval, notice period, right of withdrawal and refund terms are not decided yet and must be written in here before the service is sold.

What we promise, and what we do not

We promise that what we show you comes from your website, and that we say so when we have not read something rather than guessing at it. If we did not read a page, it says we did not read it.

We do not promise that the service is always available, that one read covers your whole website, or that anything you change on the strength of what we show produces a particular result. A read has a cap on pages and a deadline, and a site that asks us to read slowly is read as far as the deadline allows.

Leaving

You can ask for your account to be deleted. Your websites, the pages we fetched and everything belonging to them go with it — subject to the caveats about backups and stored conclusions set out in the privacy policy. Confirm whether deletion is self-service in the product today.

The grounds on which we may close an account — breach, misuse, non-payment — must be written by a lawyer.

Liability and governing law

Limitation of liability, governing law and venue are not settled. We have deliberately not written a standard form here, because a clause like this decides what happens on the day something goes wrong, and a lawyer should write it.
